LABOUR IN THE PLATFORM BASED GIG ECONOMY: THEORY, SURVEY FINDINGS, CHALLENGES & RECOMMENDATION

Abstract

The fast growth of gig economy in India, especially in the sector of quick commerce led to the watershed moment, where the nature of work has been permanently changed as it incorporates time-bound, platform-based, and algorithmic management of labour. Quick Commerce Delivery (QCD), gig workers being independent contractors becomes vulnerable as they lack formal employer-employee relationship and therefore making them with no access to social security. The digital platform provides flexibility and employment creation on the one hand and on the other hand, they pose problems such as unstable incomes, occupational safety and labour rights issues. The Code on Social Security, 2020 is a legal act that recognizes gig and platform workers, but there are no enforceable rules for the protection of these workers. The goal of this paper is to study the evolving legal framework, constitutional principles, and policy instrument addressing these disparities, with reference to the Code on Social Security, 2020, Bihar Platform Based Gig Workers Act, 2025 and empirical data on Gig workers.
